The type of personal information we collect
We do not collect any information from our website. As a company, we currently only collect and process the following information relative to an enquiry or a commission:
• Personal identifiers (name)
• Contact details (phone no., email address, postal address)
• Customer financial information (bank details)
How we get the personal information and why we have it
Most of the personal information we process is provided to us directly by you for one of the following reasons:
• To form part of, or is intended to form part of, a filing system or a communications plan.
We also receive personal information indirectly, from the following sources in the following scenarios:
• Land Registry – Whereby we receive the name, address and property details identifying the registered owners of a parcel of land in question.
We use the information that you have given us in order to enable communications relative to the service of which we are engaged, and/or in order to invoice for a service that has been undertaken.
We may share this information with our mutual client, other members of a project team or an appointing owner, or the agents of an appointing owner of land, adjacent a parcel of land in question.
Under the General Data Protection Regulation (GDPR), the lawful bases we rely on for processing this information are:
(a) Your consent. Where you have given clear consent for us to process your personal data for a specific purpose. You are able to remove your consent at any time. You can do this by contacting Paul Bannon, Director of BPS Cammes Ltd via the contact details listed in this policy.
(b) We have a contractual obligation. Where the processing is necessary for a contract we have with you, or because you have asked us to take specific steps before entering into a contract.
(c) We have a legal obligation. Where the processing is necessary for us to comply with the law - from time-to-time we may be obliged to serve legal documents on an owner of land or for court proceedings, or to hold such information for ‘other’ legal reasons.
(d) We have a legitimate interest. Where the processing is necessary for our legitimate interests or the legitimate interests of a third party, unless there is a good reason to protect your personal data which overrides those legitimate interests.
(e) We need it to perform a public task. Where the processing is necessary for you to perform a task in the public interest or for your official functions, and the task or function has a clear basis in law.
How we store your personal information
Your information is securely stored digitally on a standalone PC and backed-up via external storage device.
We keep Personal identifiers (name), Contacts details (phone number, email address, postal address) and Customer financial information (bank details) for no longer than is necessary for the purposes for which the personal data are processed (for the duration of the project).
The personal data shall then be stored for a longer period insofar as the data will be processed solely for archiving purposes; for a period of six years (or 12-years if a contract is signed as a deed). Financial information is kept for 10-years.
We will then dispose of your information by overwriting or deleting the data.
Your data protection rights
Under data protection law, you have rights including:
Your right of access - You have the right to ask us for copies of your personal information.
Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.
Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.
Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
